These Terms of Service (“Terms”) govern your access to and use of the websites, programs, and services of LarkInsights Diagnostic Learning Studio LLC, a Nevada limited liability company operating the Rahny Day brand and The Architect program (“LarkInsights,” “we,” “us,” or “our”). This includes our websites at rahnyday.com and go.rahnyday.com and any program, masterclass, discovery call, or service offered through them (together, the “Services”). By accessing the Services, registering for our masterclass, booking a call, or enrolling in a program, you agree to these Terms. If you do not agree, please do not use the Services.

1. Who May Use the Services

The Services are intended for adults. By using the Services, you confirm that you are at least 18 years old (or the legal age of majority where you live) and have the legal capacity to enter into this agreement. Our programs serve students, including minors, but the contracting party is always the parent or legal guardian, who is responsible for the enrollment, payment, and participation of the student.

2. Parent/Guardian as the Contracting Party

Where a program involves a minor student, the parent or legal guardian is our customer and the party agreeing to these Terms. By enrolling a student, you represent that you are the parent or legal guardian of that student, or are otherwise authorized to enroll them and to consent to their participation. You are responsible for your student’s conduct within the program and for any information you provide to us about your student.

3. The Program and What’s Included

The Architect is an 8-week live, online cohort program built around our proprietary diagnostic framework. Enrollment includes the program sessions, materials, and resources described on our enrollment materials at the time you enroll. The specific terms of your participation, your student’s participation, privacy, and story/media consent are set out in the separate program agreements you receive and sign as part of enrollment. Those program agreements, together with these Terms and our Privacy Policy, form the complete agreement governing your enrollment. If a specific program agreement conflicts with these Terms, the program agreement controls for that subject.

4. Fees and Payment

The fee for The Architect is the amount stated in your enrollment materials and agreement at the time of enrollment, payable in full at enrollment or under a payment-plan arrangement where offered. Payment is due as set out at the time of enrollment. Payment is processed by a third-party payment processor; your payment details are provided directly to that processor and are not stored in full on our systems. All fees are stated and payable in U.S. Dollars. Enrollment is confirmed once payment (or your first scheduled payment) is received and your program agreements are signed.

5. 72-Hour Review Window and Refund Policy

You are entitled to a full refund within seventy-two (72) hours of the initial transaction timestamp. This window exists to allow you to perform a final review of the program’s scope, schedule, and expectations before the program begins. To request a refund within this window, you must submit your request in writing to LarkInsights through the official communication channel on record.

After the 72-hour window closes, the enrollment is final. No refunds — partial or full — are issued after this point, including for student withdrawal, scheduling conflicts, or lack of participation. Where a payment-plan arrangement applies, the full balance remains due in accordance with your enrollment agreement. The specific refund terms in your signed enrollment agreement govern your enrollment.

6. Results Disclaimer

Every student is different, and learning outcomes depend on many factors outside our control, including the student’s individual circumstances, effort, and participation. We do not promise, guarantee, or warrant any specific academic result, grade, score, or outcome. The Architect provides a diagnostic and instructional process; it is not a guarantee of improved grades or performance, and it is not a substitute for medical, psychological, or special-education evaluation or services. Descriptions of past participants’ experiences are illustrative and do not predict your student’s results.

7. Intellectual Property

All content, frameworks, methods, materials, curricula, recordings, documents, logos, taglines, and other materials provided through the Services are the property of LarkInsights and are protected by intellectual property laws. This includes our diagnostic framework and all program materials. You receive a limited, personal, non-transferable license to use program materials solely for your own and your enrolled student’s participation. You may not copy, record, reproduce, distribute, publish, resell, or create derivative works from our materials, or use them to teach or train others, without our prior written permission.

8. Communications (Email and Text)

By providing your contact information and opting in, you consent to receive communications from us by email and, where you have separately consented, by text message, as described in our Privacy Policy. You may unsubscribe from marketing emails at any time, and reply STOP to opt out of text messages. Some communications (such as appointment confirmations and program logistics) are part of the service you requested.

9. Acceptable Use

You agree to use the Services lawfully and respectfully. You will not misuse the Services, attempt to disrupt or gain unauthorized access to them, infringe anyone’s rights, or upload unlawful, harmful, or offensive content. You will not share your access credentials or program materials with anyone outside your household enrollment. We may suspend or terminate access for conduct that violates these Terms.

10. Third-Party Tools and Links

The Services rely on and may link to third-party tools and platforms (for example, scheduling, video, learning-management, and payment providers). We are not responsible for the content, practices, or availability of third-party services, and your use of them may be subject to their own terms and privacy policies.

11. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the fullest extent permitted by law, LarkInsights and its owner, members, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or relating to your use of the Services or participation in any program. To the fullest extent permitted by law, our total liability for any claim relating to the Services or a program will not exceed the amount you paid to us for that program.

13. Indemnification

You agree to indemnify and hold harmless LarkInsights and its owner, members, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.

14. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Services will be brought in the state or federal courts located in Nevada, and you consent to the jurisdiction of those courts, except where applicable law provides otherwise.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
